Approving an Extension of the Terms of the Fiscal Year 2000/01 Contracts For the Department of Public Health Population Health and Prevention and Community Health Network

WHEREAS, the contractors listed on Attachment “A” currently provide health services to the residents of San Francisco through contracts with the Department of Public Health’s Population Health and Prevention and Community Health Network; and,

WHEREAS, the renewal of these contracts will not be completed through the regular contract processes prior to their expiration date of June 30, 2001, thereby causing financial hardship to the contractors listed; and,

WHEREAS, it is the intention of the Health Commission that these Contractors continue to be paid at the 2000/01 contract rate(s), as reflected in the most recent version of the 2000/01 contracts with these Contractors; and,

WHEREAS, monthly payment to the contractors listed in Attachment A, until such time as the 2001/02 contracts are certified by the Controller, will greatly reduce the financial hardship on these Contractors; and,

WHEREAS, the Department of Public Health is changing its payment practices to eliminate monthly advance payments and instead pay retroactively based on invoices; and,

WHEREAS, the change from the monthly advance payment to a retroactive payment system and the delay in renewal of the contracts, will cause financial hardship to the Contractors and disruption in services to San Francisco residents; and,

WHEREAS, the Health Commission believes that a smooth transition from one contract year to another, and from one payment system to another is important to minimize any disruption in services to San Francisco residents; and,

WHEREAS, the Health Commission did approve the acceptance and expenditure of funds from the State of California for the support of services mandated by the “Substance Abuse and Crime Prevention Act of 2000” (commonly known as “Proposition 36”) on April 17, 2001; and,

WHEREAS, State legislation mandates and it is in the interests of the City to begin expansion of existing services supported by Proposition 36 as soon as feasible; now, therefore, be it

RESOLVED, that the Health Commission hereby approves the extension of the term of each contract with those Contractors shown in Attachment A on a month-to-month basis at the 2000/01 contract rate(s) as reflected in the most recent version of their 2000/01 contracts, excepting those contracts identified by Community Substance Abuse Services prior to June 30, 2001 as receiving Proposition 36 allocations, and until such time as the 2001/02 contract is certified by the Controller or through December 31, 2001, whichever comes first. With the exception of these Proposition 36 monies, Contractors shall be paid at the fiscal year 2000/01 contract rate(s). After certification of the 2001/02 renewal contracts, the Contractor will either provide an adjustment invoice retroactively for the difference not received between the 2000/01 rates and the final increased 2001/02 negotiated rate(s) or, alternatively, be required to provide an adjustment invoice to reflect the lower 2001/02 negotiated rate(s); and, be it

FURTHER RESOLVED, that for those contracts identified as receiving Proposition 36 allocations for the expansion of existing services beginning July 1, 2001, such allocations shall be included in these extended contracts, as based on details of those allocations, to be provided to the Commission by Community Substance Abuse Services prior to

June 30, 2001. Such details shall include the name of each Contractor to be so funded, the amount of funding for each contract and the services which shall be provided. For all other services, Contractors shall be paid at the fiscal year 2000/01 contract rate(s); and, be it

FURTHER RESOLVED, that the Health Commission hereby approves the modification of each of the contracts to provide for retroactive payment based upon invoices; and, be it

FURTHER RESOLVED, that the Health Commission hereby approves the provision in each of the contracts shown in Attachment A to allow an initial payment to be paid to those Contractors which are non-profit organizations, not to exceed 25% of the contract’s maximum compensation amount of General Fund monies, and Proposition 36 monies, if applicable, with recovery of this initial payment by the City to be made upon certification of the availability of funds for the contract by the City Controller through a reduction in the payment for each remaining month of the fiscal year, in equal amounts for each month.
