Approving an Ordinance Increasing the Licensing Fee For Garbage Trucks and the Amount Deposited Into the Mandatory Refuse Collection Service Fund By Amending Section 249.6 of the San Francisco Business Tax Regulations Code and Section 10.100-7 of the San Francisco Administrative Code and Ratifying Past Actions Taken In Connection With Such Licensing Fee

WHEREAS, the Department of Public Health has proposed an ordinance increasing the licensing fee for garbage trucks and the amount deposited into the Mandatory Refuse Collection Service Fund; and,

WHEREAS, the proposed increase covers the operating costs of implementing the Mandatory Refuse Collection Ordinance passed by the Board of Supervisors and signed into law in 1987; and

WHEREAS, due to an administrative error the fee increase was not acted on by the Health Commission, however, billing at the new rate commenced in 1996; and,

WHEREAS, the proposed ordinance is intended to correct this administrative error; now, therefore, be it

RESOLVED, that the Health Commission approves the proposed amendments to Section 10.100-7 of the San Francisco Administrative Code and Section 249.6 of the San Francisco Business and Tax Regulations Code; and, be it

FURTHER RESOLVED, that the Health Commission ratifies past activities taken in connection with the collection of such licensing fee; and, be it

FURTHER RESOLVED, that the Health Commission recommends these amendments to the Board of Supervisors.
